A waste-treatment business permit (폐기물처리업 허가) can be built over decades and lost in one disposition. Some revocations under the Waste Management Act (폐기물관리법) are mandatory (기속처분): the agency must revoke once the ground applies, so a plea for leniency has nothing to work on. What can be contested is the ground itself: whether the facts and dates the agency relies on really meet the wording of the statute and the enforcement decree. We review the disposition from the pre-notice stage, and prepare the administrative appeal (행정심판) and the request for a stay of execution (집행정지).

What this covers

  • Revocation of a waste-treatment business permit, including revocation for not obtaining a suitability check (적합성확인) under Article 27(1)(1-2) of the Waste Management Act
  • The waste disposal order (폐기물 처리명령) issued with a revocation under Article 39-3
  • Business suspensions and other sanctions on a waste-treatment business, such as those that follow a storage-standard violation after a fire
  • Opinion statements (의견제출) and hearings (청문) after a pre-notice of disposition (처분 사전통지)
  • Administrative appeals to the competent commission, and a stay of execution so the business can keep running while the appeal is heard

The suitability check and its extension

A waste-treatment business has to obtain a suitability check for its facilities, valid for 5 years. When the business receives no administrative disposition and no fine or heavier penalty during that period, the validity is extended by 2 years automatically, under item 2 of Annex 5-3 of the enforcement decree. Disputes arise when a violation happens after the extension: an agency may treat the extension as lost and demand a new suitability check, then revoke the permit when none is filed.

What a published ruling shows

In one published ruling (재결례) of the Anti-Corruption and Civil Rights Commission (국민권익위원회), a business that had run a comprehensive waste recycling operation (폐기물 종합재활용업) for decades had its validity extended after a clean 5-year period. A fire during the extension led to a warning and a corrective order for breaching storage standards, and the agency, relying on its internal guideline, told the operator to apply for a new suitability check within 3 months. When no application was filed, the agency revoked the permit and issued a waste disposal order. The commission cancelled both:

  • Strict reading: a rule that takes rights away must be read by its ordinary wording and not stretched against the person affected (Supreme Court 2007두13791 and others). "Received a disposition before the validity expires" meant before the original period ended, not before the extended one ended.
  • A guideline cannot add a burden: no provision of the statute or decree says an extension ends because of a later violation, and the agency's guideline could not create that disadvantage on its own.
  • The disposal order falls with the revocation: the order is issued when a permit is revoked, so once the revocation was unlawful the order was cancelled too.

Outcomes always depend on the facts of each case.

Why an administrative appeal

  • No fee: there is no stamp duty or other appeal cost.
  • Speed: the commission decides within 60 days of receiving the appeal, extendable by 30 days where unavoidable.
  • Online filing: the appeal can be drafted and filed through the online administrative appeal site (simpan.go.kr).
  • Wider review: a court looks only at whether a disposition is unlawful; an appeal commission also looks at whether it is unjust.

What we handle

  • Reading the disposition notice against the statute, the enforcement decree and its annexes, and the agency's guideline
  • Building the timeline: the suitability check periods, the date the extension became fixed, and the date of the violation and of each disposition
  • Opinion statements and hearing preparation after a pre-notice
  • The appeal, the supplemental brief answering the agency's reply, and the request for a stay of execution

Deadlines

An appeal must be filed within 90 days of learning of the disposition and within 180 days of the disposition itself, with limited exceptions. Missing either one gets the appeal dismissed without review. The earlier the review starts, ideally at the pre-notice, the more options remain.

Frequently Asked Questions

Our permit was revoked for not filing a suitability check (적합성확인). The revocation is mandatory. Is there anything to argue?

Yes: the legal basis of the disposition itself. Because the revocation is mandatory, a plea for leniency has no room to work. In one published ruling, a revocation and the waste disposal order issued with it were both cancelled, because the validity had already been lawfully extended and no statute or decree provided that a later violation ends that extension. We compare the date of the violation with the date the extension became fixed, and check the notice against the decree and the agency's guideline.

What happens to the waste disposal order if the revocation is cancelled?

The waste disposal order is issued together with a revocation under Article 39-3 of the Waste Management Act. In the published ruling above, the revocation was unlawful, so the order was cancelled as well.

Can we keep operating while the appeal is pending?

Filing an appeal does not by itself stop a disposition. A request for a stay of execution (집행정지) asks the commission to suspend it until the appeal is decided. We prepare the request together with the appeal.

How long do we have to appeal?

Within 90 days of learning of the disposition and within 180 days of the disposition itself, with limited exceptions. Missing either deadline gets the appeal dismissed without review.

We have only received a pre-notice. Is it too early to get help?

No, that is the best time. An opinion statement or hearing after the pre-notice is the first chance to show the agency where its ground fails, and the record it creates also supports a later appeal.
